Tenant fees policy

This policy outlines the charges permitted under the Tenant Fees Act 2019. It applies to all tenants, landlords, and agents operating within the private rented sector in England, where tenancy agreements are signed or renewed on or after 1 June 2019.

Effective Date: 1 June 2019

Lettingaproperty.com complies fully with this legislation. No prohibited tenant fees are charged.


1. Purpose

To ensure compliance with the Tenant Fees Act by clearly listing permitted charges to tenants and the conditions under which they apply.


2. Permitted Payments

Landlords or letting agents may only require tenants to pay the following:

  • Rent – As agreed in the tenancy agreement.

  • Tenancy Deposit – Refundable and capped at:

    • 5 weeks' rent (if annual rent is under £50,000)

    • 6 weeks' rent (if annual rent is £50,000 or more)

  • Holding Deposit – Refundable and capped at no more than 1 week’s rent to reserve a property.

  • Early Termination Fees – When requested by the tenant and agreed by the landlord, limited to the landlord’s reasonable costs.

  • Variation, Assignment or Novation – Capped at £50 or reasonable costs if higher, for amending the tenancy at the tenant’s request.

  • Utilities & Council Tax – Tenants remain responsible for paying utility bills, communication services (e.g. broadband), TV licence, and council tax as set out in their tenancy agreement.

  • Default Fees – Only chargeable if written into the tenancy agreement:

    • Late payment of rent (interest capped at 3% above Bank of England base rate)

    • Replacement of lost keys or security devices (reasonable costs only)


3. Prohibited Fees

No other fees or charges may be imposed on tenants. This includes but is not limited to:

  • Administration or application fees

  • Inventory fees

  • Check-in/check-out fees

  • Tenancy renewal fees
